Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Codewen Inc ("Codewen", "we", "us") governing your use of the Traileo app and related services (the "Service"). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. By using it, you represent that you are 16 or older and can form a binding contract.

2. Your account

You are responsible for the information you provide, for the confidentiality of your credentials, and for all activity under your account. Sign-in is provided through Firebase Authentication, Sign in with Apple, and Google Sign-In. Notify us promptly of any unauthorized use.

3. License

Subject to these Terms, Codewen grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the app, except where this restriction is prohibited by law.

4. Subscriptions and payments

4.1 Tiers and pricing

Traileo offers a free tier and paid subscriptions (Pro and Ultra) that raise or remove usage caps and unlock additional features. Current prices, billing periods, and any free-trial terms are shown in the app at the point of purchase and may vary by region. Apple sets regional pricing.

4.2 Billing, renewal, and trials

Paid subscriptions are billed through your Apple App Store account. Subscriptions auto-renew for the same period unless canceled at least 24 hours before the end of the current period. If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Your account is charged for renewal within 24 hours before the period ends.

4.3 Managing and canceling

You manage and cancel subscriptions through your Apple ID settings. Deleting the app does not cancel a subscription. You can restore previous purchases from within the app.

4.4 Refunds

Payments are processed by Apple and subject to Apple's refund policies. Except where required by law, subscription fees are non-refundable by Codewen.

5. User content

5.1 Your content

You retain ownership of the trails, photos, and other content you create ("User Content"). By submitting User Content, you grant Codewen a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it solely to operate and provide the Service (for example, to show your published trails and profile to other users according to your visibility settings).

5.2 Responsibility and rules

You are solely responsible for your User Content and represent that you have the rights to it. You agree not to submit content that is unlawful, infringing, deceptive, harmful, or that violates others' privacy or intellectual-property rights. We may remove content or suspend accounts that violate these Terms.

5.3 Takedown

If you believe content on the Service infringes your rights, contact [LEGAL/COPYRIGHT CONTACT TBD] with sufficient detail to identify the content and your rights.

6. Acceptable use

You agree not to:

manipulate, falsify, or artificially inflate statistics, distances, rankings, or leaderboard standings, or submit data that does not reflect genuine activity;
circumvent, disable, or interfere with subscription entitlements, usage quotas, security, or access controls;
access the Service other than through the official app, scrape or bulk-collect data, or make automated or excessive requests;
upload malware, attempt unauthorized access, or disrupt the Service; or
harass, impersonate, or harm other users.

7. Outdoor activity — assumption of risk and safety

Traileo is an aid for recording and discovering outdoor activities; it is not a safety, navigation, or emergency device. Outdoor activities carry inherent risks, including serious injury or death. You are solely responsible for your own safety, preparation, equipment, fitness, and decisions. Do not rely on the Service for navigation, hazard avoidance, weather, route safety, or emergency assistance. Trail data and maps may be inaccurate, incomplete, or out of date. Always use appropriate judgment, follow local laws and land-access rules, and carry proper equipment. You assume all risks associated with your use of the Service and your outdoor activities.

8. Intellectual property

The Service, excluding User Content, is owned by Codewen and its licensors and protected by intellectual-property laws. Map data and imagery are provided by Mapbox and its data providers and subject to their terms. These Terms grant you no rights in Codewen's trademarks or branding.

9. Third-party services

The Service integrates third-party services (including Apple, Google/Firebase, RevenueCat, Mapbox, and Sentry). Your use of those services may be subject to their own terms and privacy policies. Codewen is not responsible for third-party services.

10. Apple App Store terms

You acknowledge that:

these Terms are between you and Codewen only, not Apple, and Apple is not responsible for the Service or its content;
Apple has no obligation to furnish maintenance or support for the Service;
in the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation;
Apple is not responsible for addressing any claims relating to the app, including product-liability, legal/regulatory, or consumer-protection claims;
Apple is not responsible for investigating or resolving third-party intellectual-property claims relating to the app;
you are not located in an embargoed country or on a U.S. Government restricted-parties list; and
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) survive.

12. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that trail data will be accurate. Some jurisdictions do not allow certain warranty exclusions, so some may not apply to you.

13. Limitation of liability

To the maximum extent permitted by law, Codewen and its officers, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or for personal injury arising from your outdoor activities or reliance on the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or [USD 50 / amount TBD]. Nothing here limits liability that cannot be limited by law. Consumers retain all mandatory statutory rights.

14. Indemnification

You agree to indemnify and hold harmless Codewen from claims and expenses arising out of your User Content, your use of the Service, or your violation of these Terms or of any law or third-party right, except to the extent prohibited by law.

15. Changes to the Service and Terms

We may modify or discontinue features at any time. We may update these Terms; when we make material changes we will update the "Last updated" date and, where appropriate, notify you in the app. Continued use after changes take effect constitutes acceptance.

16. Governing law and disputes

These Terms are governed by the laws of [STATE], United States, without regard to conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply.
